NOTICE OF PUBLIC HEARING

Proposed Ordinance to Consider the Return of all or a Portion of Surplus Funds from the Sale of Real Estate for Delinquent Taxes

The Caroline County Board of Supervisors will hold a public hearing on Tuesday, January 26, 2021, beginning at 7:30 p.m., or as soon thereafter as the matter may be heard, in the Community Services Center Auditorium, located at 17202 Richmond Turnpike, Milford, Virginia, to consider the return of all or a portion of surplus funds received from the sale of real estate for delinquent taxes in excess of the taxes, penalties, interest, reasonable attorneys' fees, costs and any liens chargeable thereon. The previous owner of the real property in question is believed to be 7263 Ladysmith, LLC, Christopher S. Schuster, Trustee in Liquidation. The real estate is described as follows: 1.47 acres, Improved, 7263 Ladysmith Road, Tax Map ID No. 52-A-62; more particularly described in Deed Book 1107 at Page 525.

§58.1-3967 of the Code of Virginia provides, upon the request of the former owner, his heirs or assigns, or unknown beneficiary of any real estate sold under this article, and after a showing of a prior entitlement thereto, the governing body of any county or city which has received such surplus funds may, in its discretion, grant relief, by ordinance, to such former owner, heir, or assign, or unknown beneficiary and pay over such amount as the governing body may deem appropriate to such former owner, heir, assign, or unknown beneficiary.

Due to the public health threat posed by the COVID-19 pandemic, the in-person gathering size in the meeting room is limited based on guidance and executive orders from the Governor of Virginia and the Virginia Department of Health on social distancing and public gatherings. Accordingly, public comment will also be accepted in writing prior to the meeting to be entered into the official minutes of the Caroline County Board of Supervisors and read by the Chair or designee at the Board meeting.

Those wishing to submit written comments may do so by emailing comments to Pam Hall at the County Administrator’s Office or by placing written comments in the Treasurer’s Office drop box outside the front door of the County Administrative Building at 212 N. Main Street, Bowling Green, VA 22427. Comments submitted via the Treasurer’s Office drop box should be in a sealed envelope clearly marked “Comments for Public Hearing to Consider Return of All or a Portion of Surplus Funds from the Sale of Real Estate for Delinquent Taxes.” Written comments may also be mailed to the attention of Pam Hall, County Administrator’s Office, P. O. Box 447, Bowling Green, VA 22427. All comments must be received by close of business on FRIDAY, JANUARY 22, 2021 in order to be read into the public record at the hearing.

Submissions of written comments must include the citizen’s name and voting district. Please draft your comments at such length so that they may be read into the record in no more than three (3) minutes at a typical oral reading pace. For comments provided in representation of a group or organization, the time limit is five (5) minutes. The reading of any comments that exceed these time limits will stop when the time limit is reached.

Citizens choosing to attend in person to address the Board of Supervisors at the public hearing will be required to maintain recommended social distancing at all times, wear masks and have their temperature taken before entering the building.

TXT-13-2020: An Ordinance to amend the Zoning Ordinance of Caroline County by Amending Article II, Definitions to repeal the definition of “Commercial Kennel” and add definitions for “Commercial Kennel-Indoor” and “Commercial Kennel-Outdoor”.

TXT-14-2020: An Ordinance to amend the Zoning Ordinance of Caroline County by amending Article IX, B-1 Business, Section 2, Uses Permitted by Right to add paragraph 32 “Commercial Kennel, Indoor” as a permitted use in the B-1 Zoning District.

TXT-15-2020: An Ordinance to amend the Zoning Ordinance of Caroline County by amending Article IX, Section 3, Uses Permitted by Special Exception to add paragraph 22 “Commercial Kennel, Outdoor” as a use permitted by Special Exception in the B-1 Zoning District.

TXT-16-2020: An Ordinance to amend the Zoning Ordinance of Caroline County by amending Article X, M-1 Industrial, Section 2, Uses Permitted by Right, to: 1) repeal paragraph 5, “Animal hospitals and kennels”; and 2) Replace paragraph 5 with “Animal Hospitals and Commercial Kennel, indoor”.

TXT-17-2020: An Ordinance to amend the Zoning Ordinance of Caroline County by amending Article X, M-1 Industrial, Section 3, Uses Permitted by Special Exception to add paragraph 24 “Commercial Kennel, Outdoor” as a use permitted by special exception in the M-1 zoning district.

TXT-22-2020: An Ordinance to amend the Zoning Ordinance of Caroline County by amending Article XV (Supplemental Regulations), Section 3 (Exceptions to Height Requirements). The purpose of this amendment is to clarify and revise the height exceptions of Section 3, which are applicable to aspects of principal structures necessary to meet operational requirements and are inapplicable to accessory structures.

TXT-23-2020: An Ordinance to amend the Zoning Ordinance of Caroline County by amending Article XV (Supplemental Regulations), Section 15 (Highway Corridor Overlay District). The purpose of this amendment is to 1) add Paragraph 15.2.10 to include Interstate 95 within the HCOD District Boundaries and 2) modify Section 15.6.4, Lot and Other Dimensional Requirements to establish a minimum setback for all structures abutting Interstate 95.

TXT-24-2020: An Ordinance to amend the Zoning Ordinance of Caroline County by amending Article XV (Supplemental Regulations), Section 8 (Development Standards), to add Paragraph W. The purpose of this amendment is to establish Development Standards for a Commercial Kennel (Indoor).

TXT-25-2020: An Ordinance to amend the Zoning Ordinance of Caroline County by amending Article XV (Supplemental Regulations), Section 8.B (Development Standards for Communication Facilities). The purpose of this amendment is to update the development standards for communication facilities in accordance with Virginia Code § 15.2-2316.3, et seq. (Zoning for Wireless Infrastructure) and to amend the height limitations.
